Chapter 13
Existing tax liabilities and delinquencies are often managed in Chapter 13 plans. If these are not paid by the Mortgage Company and added to the escrow amounts, then they can be set up as a separate claim in the plan. Payments are made through the Chapter 13 Trustee if they are in a payment plan. Debtor is responsible for all taxes due after the date the bankruptcy was filed. If the debtor does not have a payment plan, they are responsible for all taxes. Taxes need to paid current by the time the bankruptcy case is closed. This office will file a claim on delinquent taxes at the time of the Bankruptcy Filing.
Chapter 7
There are not payment plans for a debtor that has filed for a Chapter 7 bankruptcy. Debtor is responsible for all taxes. Taxes need to be paid current by the time the bankruptcy case is closed.
Chapter 11 (Company)
There are not payment plans for a debtor that has filed for a Chapter 11 bankruptcy. Debtor is responsible for all taxes. Taxes need to be paid current by the time the bankruptcy case is closed.
Chapter 12 (Farmer)
A Chapter 12 bankruptcy filing is treated the same as a Chapter 7 & Chapter 11.
